UBERFUZZ, UBERFUZZ.COM, UBERFUZZ, UBERFUZZ.COM, UBERFUZZ CLASSIFIEDS, UBERFUZZ CLASSIFIEDS, UBERFUZZ FORUMS, UBERFUZZ PERSONALS, UBERFUZZ CHAT, UBERFUZZ JOB-SEARCH are a collection of resources in the form of classified ads, posts, news, pages, forums, search engines, chat rooms, and email services operated from www.UBERFUZZ.COM
referred to as UBERFUZZ the Site, on the Terms Of Use (TOU) set out below. By accessing or using the Site in any way, users are deemed to have agreed to the following terms and to comply with the (TOU). If a user does not accept the Terms of Use (TOU), they are not permitted to use or access the Site. UBERFUZZ is a registered trademark with the United States Patent and Trademark Office.

UBERFUZZ may make changes to these terms at any time and a user's continued access of the Site constitutes acceptance of and an agreement to be bound by the most recent Terms Of Use displayed on the Site. You must review the (TOU) on a regular basis to stay informed of any and all changes. If you do not agree with any term or condition of the (TOU), guidelines, or modifications made at any time, your only option is to discontinue use of our collection of resources, collectively known as UBERFUZZ. UBERFUZZ is not obligated to, but has the right to enforce the (TOU) through administrator moderations, member moderation, including partial and total bans to the services, active investigation, litigation and prosecution. a) Access to the Site
Users are responsible for providing all of the equipment required to access the Site. This includes, but is not limited to, all hardware, software, telephone or other communication equipment and or/service used to connect to the internet and access the Site. Users are also responsible for all internet access charges, telephone charges and other fees or charges incurred in connecting to the internet and accessing the Site. UBERFUZZ does not guarantee uninterrupted, error-free or secure access to the Site. UBERFUZZ does not warrant that the Site or electronic mail delivered through the Site will be free from viruses or other malicious code. Further, users are responsible for employing sufficient procedures to help fulfill their requirements for accuracy of data input and output (i.e. anti-spyware programs, anti-virus programs, registry cleaners, etc.). Users are responsible for maintaining a means external to the Site for the reconstruction of any lost data (i.e. backup files, hard drives).
b) Posting Content
UBERFUZZ reserves the right to approve, refuse, delete or edit {Content} posted on the Site at its own discretion. {Content} can be, but is not limited to, all the postings: advertisements, messages, posts, blogs, files, images, text, photos, sounds, video, or other {Content}posted on, transmitted through, or linked from UBERFUZZ the Site. UBERFUZZ also reserves the right to terminate access to, or use of the Site, with or without notice to the affected users, without the need to provide reasons.
You understand that all the postings: messages, posts, blogs, files, images, text, photos, sounds, video, or other {Content} posted on, transmitted through, or linked from UBERFUZZ the Site, are the sole responsibility of the person from whom such {Content} originated. Specifically, you are entirely responsible for each individual item of {Content} that you post, email, or otherwise make available via the Site. You understand that UBERFUZZ does not control, and is not responsible for {Content} made available through the Site, and that by using the Site, you may be exposed to {Content} that is misleading, inaccurate, indecent, offensive, or otherwise objectionable. Furthermore, UBERFUZZ and {Content} available through the Site may contain links to other websites, which are completely independent of UBERFUZZ UBERFUZZ makes no representation or warranty as to the accuracy, completeness, or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk.
You agree that you must evaluate, and bear all risks associated with the use of any {Content} on the Site. That you may not rely on said {Content}, and that under no circumstances will UBERFUZZ be liable in any way for any {Content} or for any loss or damage of any kind incurred as a result of the use of any {Content} that is; posted, emailed, or otherwise made available via the Site. You acknowledge that UBERFUZZ does not approve nor pre-screen {Content}, but that UBERFUZZ shall have the right (not the obligation) in it's sole discretion to delete, refuse, or move any {Content} that is available via the Site, for violating the letter and/or the spirit of the (TOU) or for any other reason.
c) Third party Content, Sites, and Services
UBERFUZZ and {Content} available through the Service may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of UBERFUZZ, including web sites, servers, directories, applications, software, networks, programs, systems, information and databases, products or services, and the Internet as a whole. The inclusion of a link does not imply an endorsement by UBERFUZZ for the linked site.
Your interactions with individuals and/or organizations found on or through the Site, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such individuals and/or organizations. You should make whatever investigation you feel necessary and/or appropriate before proceeding with any online or offline transaction with any of these Third parties.
You agree that UBERFUZZ shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such transactions. If there is a dispute between participants on this Site, or between users and any third party, you understand and agree that UBERFUZZ is under no obligation to become involved. In the event that you have a dispute with one or more other users, or between users and any third party, you hereby release UBERFUZZ, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our Site, UBERFUZZ.
INDEMNIFICATION

Users agree to indemnify UBERFUZZ and its officers, employees, agents and successors in rights from any claims and expenses (including legal costs) related to:
a) access or use of the site;
b) content posted by the user or others;
c) or breach of these terms.
USER IMPERATIVES
UBERFUZZ ENDEAVORS TO KEEP AN OPEN MIND TOWARD CONTENT THAT IS POSTED, Nevertheless;
Content posted to the Site, whether; advertisements, messages, blogs, posts, emails, photos, texts, sounds, video, or other forms of Content, must:
a) conform to applicable federal, state, and local laws and regulations;
b) not have abusive, harmful, threatening, harassing, defamatory, libelous content;
c) not invade a person's privacy;
d) not contain pornographic, sexual conduct, including but not limited to (i) sexual intercourse, i.e. genital/genital, anal/genital, oral/anal, or oral/genital, regardless of gender, or (ii) bestiality, or (iii) lascivious exhibition of the genitals or pubic area of any person, or (iv) sadistic or masochistic acts, or (v) masturbation, (This does not include adult conversations in the adult category of Uberfuzz forums, in Uberfuzz classified personals, or in Uberfuzz chat rooms);
e) not contain content that harasses, intimidates, degrades, or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
f) not violate the Fair Housing Act by stating, in any notice or ad for the sale or rental of any dwelling, a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap (or violates any state or local law prohibiting discrimination on the basis of these or other characteristics);
g) not violate federal, state, or local equal employment opportunity laws, including but not limited to, stating in any advertisement for employment a preference or requirement based on race, color, religion, sex, national origin, age, or disability;
h) not impersonate any person or entity, including, but not limited to, an UBERFUZZ employee, or falsely state or otherwise misrepresent your affiliation with a person or entity. (Content that constitutes lawful non-deceptive parody of public figures does not apply to this condition.);
i) accurately describe the item(s) or service(s) that are being sold, sought, given, etc. and be placed under the most appropriate category;
j) not be posted more than once, (i.e. same advertisement posted multiple times in one category);
k) not be placed in different categories if its the same ad, (i.e. same advertisement posted in different categories);
l) respect other users;
m) be posted by an Adult, over 18 years of age. No one under 18 years of age is allowed to use the site. If you are under 18 years of age please leave the site now! This Site is for ADULTS;
n) not be posted or transmitted that contains viruses, malware, spyware, or any other harmful components;
In addition to the above, As a condition of using the Site, Users are:
o) not to use or manipulate the Site for any fraudulent activity or purpose;
p) not to disclose the contact details of any person obtained through use of the Site, without the prior consent of that person;
q) not to claim a relationship with any business or organization for which the user is not authorized to claim such a relationship;
r) not to attempt to gain unauthorized access to the Site using another user's details;
s) not to edit or delete any content posted by another user without first obtaining permission from that user;
t) not to make unauthorized modifications to the Site

You further acknowledge and agree that UBERFUZZ may, in its sole discretion, preserve or disclose your {Content}, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:
comply with legal process; enforce the (TOU); respond to claims that any {content} violates the rights of third-parties; respond to claims that the contact information (i.e. phone number, street address) of a third-party has been posted or transmitted without their consent or as a form of harassment; protect the rights, property, or personal safety of UBERFUZZ and its officers, employees, agents and successors in rights, its users or the general public.
